Terms of Service
Please read these terms carefully before using MyKidzHealth. They govern your access to and use of our pediatric telehealth platform.

1Acceptance of Terms
- By creating an account, accessing, or using MyKidzHealth's platform and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our services.
- These Terms constitute a legally binding agreement between you and MyKidzHealth Inc. ("MyKidzHealth", "we", "us", or "our"), a company incorporated under the laws of Ontario, Canada.
- You must be at least 18 years of age and a resident of Ontario, Canada to create an account. By registering, you confirm that you are the parent or legal guardian of any minor child for whom you are seeking care.
2Description of Services
- MyKidzHealth provides an on-demand virtual pediatric telehealth platform ("Service") that connects Ontario families with licensed clinicians — including pediatricians, family physicians, and nurse practitioners — via secure video, audio, and chat consultations.
- Our services are available during designated operating hours: evenings, nights, and weekends. Hours are subject to change and will be communicated through the platform.
- MyKidzHealth is a supplemental telehealth service. It is NOT a replacement for your child's primary care physician, specialist care, or emergency medical services.
3Not an Emergency Service
- MyKidzHealth is NOT intended for medical emergencies. If your child is experiencing a life-threatening condition, difficulty breathing, severe allergic reaction, loss of consciousness, or any emergency, call 911 or proceed immediately to the nearest emergency department.
- Clinicians on our platform may, at their discretion, direct you to seek in-person or emergency care when they determine that a virtual consultation is not adequate to safely assess or treat your child's condition.
- By using this service, you acknowledge you understand its limitations and will seek emergency care when appropriate.
4Your Account
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You agree to provide accurate, current, and complete information during registration and to update this information as necessary.
- You may not share your account credentials or allow others to access your account. Each account is for a single family unit.
- We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in any form of misuse or abuse of the platform.
5Subscriptions & Payments
- MyKidzHealth offers subscription-based access plans. Pricing, features, and billing cycles are described on our pricing page and may be updated from time to time with reasonable notice.
- Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. Cancellation instructions are available in your account settings.
- All fees are charged in Canadian dollars (CAD). Taxes applicable under Ontario and federal law will be applied where required.
- Refund requests are evaluated on a case-by-case basis. MyKidzHealth does not guarantee refunds for partial billing periods or unused consultations.
- We reserve the right to modify pricing with a minimum of 30 days' notice to active subscribers.
6Acceptable Use
- You agree to use MyKidzHealth solely for lawful purposes and in a manner consistent with these Terms.
- You must not: impersonate another person, provide false health information, record consultations without consent, attempt to access other users' accounts, or use the platform to engage in any fraudulent activity.
- You must treat all clinicians and staff with respect. MyKidzHealth reserves the right to terminate access for abusive, threatening, or inappropriate behaviour.
- You are responsible for ensuring you have a stable internet connection and appropriate device for conducting virtual consultations.
7Clinical Care & Limitations
- Our clinicians are licensed in Ontario and provide care in accordance with applicable professional standards and the guidelines of their regulatory colleges.
- Diagnoses, prescriptions, referrals, and treatment recommendations made through our platform are based on the information you provide and the clinician's professional judgment. Outcomes cannot be guaranteed.
- Clinicians may decline to prescribe certain medications (including controlled substances) via telehealth where clinically inappropriate or contrary to regulatory guidelines.
- If a clinician determines that an in-person assessment is required, you agree to follow their recommendation and, where applicable, seek appropriate in-person care.
8Intellectual Property
- All content, software, branding, graphics, and materials on the MyKidzHealth platform are the property of MyKidzHealth Inc. or its licensors and are protected by applicable copyright, trademark, and intellectual property laws.
- You are granted a limited, non-exclusive, non-transferable licence to access and use the platform for your personal, non-commercial use only.
- You may not copy, reproduce, modify, distribute, or create derivative works from any platform content without our prior written consent.
9Limitation of Liability
- To the maximum extent permitted by applicable law, MyKidzHealth shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our services.
- Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
- Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by Ontario law.
10Termination
- You may cancel your account at any time through your account settings or by contacting support@mykidzhealth.ca.
- We may suspend or terminate your access without notice if we determine you have violated these Terms, engaged in fraudulent activity, or if we are required to do so by law.
- Upon termination, your right to access the platform ceases. Data retention is governed by our Privacy Policy and applicable health records legislation.
11Governing Law
- These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
- Any disputes shall be resolved through binding arbitration in Ontario, except that either party may seek injunctive relief in a court of competent jurisdiction.
- If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- These Terms were last updated on April 20, 2026. We may update these Terms and will notify registered users of material changes. Continued use of the Service after notice constitutes acceptance.
